On September 16, 2008, Peter Benson filed a class action complaint in the United States District Court for the Eastern District of Pennsylvania against Budget Rent A Car and JNR Adjustment Company. Benson charges Budget and JNR with violations of the Fair Debt Collection Practices Act, Pennsylvania Fair Credit Extension Uniformity Act and Pennsylvania Unfair Trade Practices Act. Plaintiffs allege that Defendants violated these Acts by:- assessing charges or fees, loss of rental value and/or any fees or charges not authorized under the Rental Agreement;
- assessing charges based on a valuation of the rental car that exceeded the retail fair market value of the car;
- failing to repair the car prior to the sale of the rental car;
- use of dealer only auctions for sale of the rental car;
