On December 26, 2006, Dennis and Rita O'Neill filed a complaint against Argent Mortgage Company in the United States District Court for the Northern District of Illinois. The O'Neills charge defendants Argent Mortgage Company with violations of the Truth in Lending Act and violations of Massachusetts consumer protection laws. The O'Neills' right to rescind their Argent mortgage arose when the plaintiffs were provided defective Notice of Right to Cancel forms. Also plaintiffs allege that Argent violated Massachusetts consumer protection laws by engaging in a bait and switch by offering a relatively favorable set of terms and then switching to less favorable terms at the closing.The complaint can be accessed by clicking on:
