On October 9, 2008, Mitchell and Randi Schwartz filed a complaint in the United States District Court for the Eastern District of Pennsylvania against NovaStar Mortgage. Mr. and Mrs. Schwartz charge defendant NovaStar Mortgage with a violation of the Truth in Lending Act by failing to honor a valid rescission request.
