On September 26, 2005 the Silvases filed a class action complaint in the Superior Court of California, Orange County against E*TRADE Mortgage. The Silvases charge E*TRADE Mortgage with misinforming the Silvases, and other customers similarly situated, as to their rescission rights under the Truth in Lending Act by incorrectly stating that their appraisal fee was non-refundable.
