On September 8, 2006, The Solnins filed a complaint in the United States District Court for the Northern District of Illinois. The Solnins charge defendants Ameriquest Mortgage Company and AMC Mortgage Services, Inc. with violation of the Truth in Lending Act by failing to honor a valid rescission request and violation of New York law. The Solnins' right to rescind their Ameriquest mortgage arose when the Solnins were provided defective Notice of Right to Cancel forms, when Ameriquest did not provide the Solnins with copies of the loan documents at the closing, when Ameriquest did not correctly inform Mr. Solnin of his right to cancel the mortgage during the 3 day rescission period, charging the Solnins' a non-refundable appraisal fee and paying the prior lender more than they were owed. Also the Solnins allege that Ameriquest violated New York law by engaging in a bait and switch by baiting plaintiffs into the mortgage transaction by offering a relatively favorable set of terms and then switching to less favorable terms at the closing.The complaint can be accessed by clicking on:
